The Planning Officer presented the application for the change of use from mixed use premises (Class E - Commercial, Business and Service and Class C3 - residential) to 8 no. bedroom House of Multiple Occupation (HMO) (sui generis), and replacement of the front and rear windows with uPVC sliding sash windows to the front elevation and uPVC casement windows to the rear. No updates had been received since the report was published. Members viewed the location plan, block plan, aerial view, and front elevation. The Planning Officer explained that the application proposed replacing the existing timber-framed windows with double-glazed UPVC sliding sash windows to the front elevation and UPVC casement windows to the rear, the replacement was considered acceptable because the property was not within a conservation area. There were examples of UPVC windows elsewhere on the road, and the change would apply to the whole building rather than individual floors, which was considered acceptable. The proposed HMO would provide eight single bedrooms, six with their own kitchenette and shared bathrooms, and two bedrooms on the second floor with shared cooking and bathroom facilities. All rooms met the nationally described and HBC-adopted standards in terms of size. HMO licensing had reviewed the application and raised no objections.
- p8Councillors Sinden and Rogers expressed support for the proposal as part of addressing the need for additional HMOs in the area, particularly for single people. Councillor Collins was concerned about the effectiveness of the monitoring of HMOs and said that complaints about antisocial behaviour from HMOs were frequent. The Chair responded that the broader matter of antisocial behaviour was not a consideration for the application before Members but might be suitable for review by the Overview and Scrutiny Committee. Councillor Cannon supported the proposal, stressing that the behaviour of future residents was not a planning consideration and cautioned against preconceived ideas about HMOs. Councillor Horn commented positively on the design of the HMO, particularly the individual kitchenettes and shared bathrooms, and welcomed the inclusion of the lockable bin store, which addressed concerns about waste management. Councillor Beaver proposed approval of the application, seconded by Councillor Sinden, whereupon the Committee: RESOLVED (unanimously) to: Grant Full Planning Permission subject to the following conditions: 1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. 2. The development hereby permitted shall be carried out in accordance with the following approved plans: HAST52MPR001 HAST52MPR101 HAST52MPR005 HAST52MPR00 HAST52MPR004 Rev F HMO Management plan Rev B 3. Prior to first occupation, the cycle storage details approved to the following specification must be fully implemented in accordance with the approved location detailed in drawing no. HAST52MPR004 REV. The approved cycle storage must be retained and maintained thereafter for the lifetime of the deveopment . 4. Prior to first occupation, the waste and recycling storage details to fit 8 no. wheelie bins approved to the following specification must be fully implemented in accordance with the approved location detailed in drawing no.

With the exception of internal works the building works required to carry out the development allowed by this permission must only be carried out within the following times:- 08.00 - 18.00 Monday to Friday 08.00 - 13.00 on Saturdays No working on Sundays or Public Holidays. 6. The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with materials noted on drawing number 11. The approved materials used in connection with the extension shall thereafter be retained. Reasons: 1. This condition is imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act 1990. 2. For the avoidance of doubt and in the interests of proper planning. 3. In order that the development site is accessible by non-car modes and to meet the objectives of sustainable transport. 4. In order to secure a well planned development that functions properly. 5. Failure to comply with any condition imposed on this permission may result in enforcement action without further warning. 2. The Levelling Up and Regeneration Act 2023 has introduced an amendment to the Town and Country Planning Act 1990 (TCPA), specifically adding section 93G.
