- p10It was emphasised that no consultees had objected to the application. With the consent of the Committee, the Planning Manager provided wording for an informative: The applicant is encouraged to partner voluntarily with a local fishing club to help reinforce best practice. Cllr Collins reiterated concern about the potential impact on local wildlife and asked whether a short?term trial period could be considered to assess compliance. The Planning Manager cautioned that was not what had been applied for and therefore could not be considered. In summing up, the Chair expressed contentment that the application would facilitate green, outdoor activity for the community and was satisfied that an appropriate management plan would be in place to support its responsible operation. With approval of the application having been proposed by Councillor Sinden, seconded by Councillor Whitehill, the Chair called upon the Committee to vote whereupon it was RESOLVED: To Grant Full Planning Permission subject to additional informative no.6 and the following conditions: 1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. 2. The development hereby permitted shall be carried out in accordance with the following approved plans: 23.526/02B 23.526/01C Ecology Report prepared by The Mayhew Consultancy Ltd dated May 2024 Ecology Report Addendum prepared by Futurenature Consulting dated 28 th November 2025 Flood Risk Assessment prepared by Herrington dated August 2025 Management Plan Pathway Maintenance Details 3. The works hereby approved shall be carried out in accordance with the recommendations within the Ecology Assessment dated May 2024 produced by The Mayhew Consultancy Ltd. 4.
- p11Prior to first use of the reservoir for fishing purposes, details of the two floating islands shown on drawing 23.526/01C, including their design, dimensions, location, planting specification, and maintenance regime, shall be submitted to and approved in writing by the Local Planning Authority. The floating islands shall be installed in accordance with the approved details and shall be retained and maintained thereafter in accordance with these approved details. 5. The post and rail fencing shown on drawing 23.526/01C erected for the purpose of preventing access to the adjacent ancient woodland, shall be installed prior to first use of the reservoir for fishing purposes and shall be retained and maintained thereafter. 6. The use of the reservoir for fishing purposes shall be carried out and managed in full accordance with the approved Management Plan submitted 02 September 2025 unless otherwise agreed in writing by the Local Planning Authority. 7. The use of the reservoir for fishing purposes shall be limited to no more than ten fishing parties per day, with a maximum of three persons per fishing party, present at the reservoir at any one time, in accordance with the approved Management Plan. 8. The site shall not be used by the public except between the following hours:- Monday - Sunday 07:00-21:00 9. No machinery, equipment, or other items associated with the maintenance or operation of the fishing use shall be stored within the red line boundary shown on drawing no. 23.526/01C, unless otherwise agreed in writing by the Local Planning Authority. 10. With the exception of internal works the building works required to carry out the development allowed by this permission must only be carried out within the following times:- 08.00 - 18.00 Monday to Friday 08.00 - 13.00 on Saturdays No working on Sundays or Public Holidays. Reasons: 1. This condition is imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act 1990. 2.
- p13The Levelling Up and Regeneration Act 2023 has introduced an amendment to the Town and Country Planning Act 1990 (TCPA), specifically adding section 93G. This new section requires that applicants must inform the Local Planning Authority about their planned start date for any development that has received planning permission, including development that has been granted a variation permission under section 73 by way of notice. Further information and an online form to submit details of commencement is available on our website at www.hastings.gov.uk/planning/comm_notice Should there be a change in the planned start date provided in the initial notice, the applicant is required to issue a new commencement notice detailing the revised expected start date. This requirement applies both to situations where the development has not started by the initially stated date and when the applicant decides to commence earlier or later than originally planned, prior to the actual start of development. Please note, this notification does not remove the obligation for you to formally discharge planning conditions. 4. The applicant is advised that should any works to trees covered by a Tree Protection Order are required to maintain the access pathway to the site, a separate application for tree works consent will be required. 5. The applicant is reminded that the reservoir shall not be open to public access for fishing purposes during any period in which a weather warning relevant to the site is in force for the area, as issued by the Met Office, in accordance with the submitted Flood Risk Assessment produced by Herrington dated August 2025. 6. The applicant is encouraged to partner voluntarily with a local fishing club to help reinforce best practice.
