Land East of 46 Conqueror Road, St Leonards-on-sea (HS/FA/25/00614) Proposal Construction of two houses on Land East of 46 Conqueror Road, St Leonards-on-sea, TN38 8DD Application No. HS/FA/25/00614 Conservation Area No Listed Building No Public Consultation Petition contrary to officer recommendation received Will Larkin, Senior Planning Officer, presented the proposal for the construction of a pair of semi ? detached, two ? storey, three ? bedroom dwellings on land situated to the east of 46 Conqueror Road. The item had come before the committee due to the number of comments in objection, together with a valid petition in opposition to the recommendation. There had been no updates since the publication of the report. The location of the site was outlined, with Conqueror Road positioned to the west, becoming William Road to the north. The section of Conqueror Road relevant to the application lay beyond a give way junction and formed a cul ? de ? sac. The topography of the area included a steep slope running west to east together with a further fall from north to south. The surrounding character comprised elevated semi ? detached and detached bungalows on the northern side, with semi ? detached bungalows occupying the southern side. A block plan was presented, illustrating the relationship of the site to footpaths running along its northern and eastern boundaries. The eastern path formed part of public right of way Hastings 415, while the northern route linked Conqueror Road with Edinburgh Road. An aerial photograph showed the site outlined in red, and reference had been made to the local wildlife site to the southeast, located at the end of Conqueror Road. Photographs taken in January were shown, depicting views toward the south and west. The committee had been advised that surface ? water flood risk at the site was low, and the area lay outside the surface water flood zone.
  • p24At the invitation of the Chair, the Senior Planning Officer offered revised wording for condition 20: “No development shall take place until an ecological design strategy addressing on-site ecological compensation and enhancement measures to include soft landscaping of value to wildlife, and details of bat and bird bricks / boxes has been submitted to and approved in writing by the local Planning Authority. The approved details shall thereafter be retained and maintained in accordance with the approved details.” Together with new condition 36: “Notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015 or any order revoking and re-enacting that order with or without modification, no extensions permitted by Class A, no porches permitted by Class D, and no outbuildings or swimming pools permitted by Class E of Part 1, Schedule 2 of the order shall be carried out without prior written consent of the Local Planning Authority.” With approval of the application having been proposed by Councillor Horn, seconded by Councillor Smith, the Committee voted and it was: RESOLVED by 8 votes for and 1 vote against (Cllr Beaver): Cllr Beaver requested that his vote against the proposal be recorded in accordance with rule 18.5. To grant Full Planning Permission subject to revised condition no20, and new condition no36; and the following conditions. 1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. 2. Application No. HS/FA/25/00006 Conservation Area No Listed Building No Public Consultation 5 or more letters of objection received At the invitation of the Chair, Tom Bagshaw, Principal Planning Officer presented a proposal that sought permission for two new three?bedroom semi?detached dwellings with associated parking and landscaping at 96 Victoria Avenue, following the demolition of an existing residential garage. It was confirmed that the demolition had already taken place. An additional objection from a neighbour had been submitted after publication of the committee report. The Principal Planning Officer read the objection. In summary, the neighbour disputed statements within the report concerning the layout and history of windows at number 96. The objector stated that the report incorrectly suggested that a rear extension had replaced an original rear window and that the principal light sources to the kitchen and first?floor bedroom were now side?facing. The neighbour maintained that the first?floor bedroom window had always been in its original position and had provided supporting documentation, which was displayed to the committee. The objector also argued that the proposed development would result in significant loss of light and harm the outlook from this habitable room, referring to rights under the Prescription Act 1832. Although the applicant had amended the roof design, the neighbour remained dissatisfied and felt the works still interfered with the light reaching their bedroom window. The objection expressed concern that the report had implied the owners had reduced their own light levels by constructing the extension. The neighbour disputed this, stating that the bedroom window had never changed.
  • p53With approval of the application having been proposed by Councillor Cannan, seconded by Councillor Sinden, the Chair called upon the Committee to vote whereupon it was RESOLVED by 6 votes for and 2 votes against To Grant Full Planning Permission subject to the following conditions: 1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. 2. The development hereby permitted shall be carried out in accordance with the following approved plans: BA2420.13A; BA2420.10G; BA2420.02; DR-D-0350-S4 P01; DR-D-1200-S3 P02; DR-D-1220-S4 P02; DR-D-12201-S4 P01 3. The materials to be used must match as closely as possible, in type, colour and texture those listed in the materials Section of the application form. 4. Prior to commencement of development a Construction Management Plan shall be submitted to and approved in writing by the Local Planning Authority. The approved Construction Management Plan shall be adhered to throughout the construction period. The Plan shall provide for: a) An indicative programme for carrying out of the works b) The arrangements for public consultation and liaison during the construction works c) Measures to minimise the noise (including vibration) generated by the construction process to include hours of work, proposed method of piling for foundations, the careful selection of plant and machinery and use of noise mitigation barrier(s). d) Storage of plant and materials used in constructing the development e) The erection and maintenance of security hoarding including decorative displays and facilities for public viewing where appropriate.
