  • p2Address: Grand Pera, 8-9 Harold Place, Hastings, TN34 1JA Review of Premises Licence Dear Stewart Under the Licensing regime the role of Environmental Health is to avoid the creation of situations where in a licenced premises by virtue of their proposed activities, their locations, or times of operation, give rise to nuisance to local residents. In this respect the provisions of the Environmental Protection Act 1990 provide some protection to the general public from the effects of noise nuisance. However, these may not, by themselves, be sufficient to protect local residents. I have concerns with the day to day running of this establishment, due to complaints received about the premises and the ability to manage the premises, in respect of the Licensing objectives, especially the Prevention of Public Nuisance. To date: We have received complaints from residents of Queens Apartments regarding noise from amplified music during the evenings and noise from glass bin collections very early in the morning. The owner of the premises was contacted about this and an appointment made to meet him at the restaurant to discuss the matters. He confirmed that he would be available but did not turn up for the meeting. Subsequently a letter was sent to him outlining the issues but we did not receive a response. Due to the lack of communication from him we contacted Veolia regarding the early morning glass bin collections.
  • p3We have concerns over the control of noise from the restaurant and seemingly lack of adherence to the licensing objectives. Environmental Health can only conclude that given the reported breaches of the licence, the compliance with the suggested conditions is unlikely to be achieved and as such, the premises would have a negative impact on the surrounding area.
  • p4Recommendations: MEMORANDUM It is the opinion of Environmental Health that given the stated points above, that the revocation of the licence would be appropriate in this case and would ask the committee to seriously consider this action.
