Sussex Police, as a Responsible Authority under the Licensing Act 2003, has submitted a letter supporting the review of the premises licence for Shish Turkish Kebab, 42 Robertson Street, Hastings, under the crime and disorder licensing objective. p3p4

The letter states that on 24 July 2026 an officer observed the premises open and trading after 23:00 hours while its Late Night Refreshment licence was suspended for non-payment of fees, and that no SIA-licensed door supervisors were on duty as the licence conditions require. p17p18p19p20

The letter states that the Designated Premises Supervisor was interviewed under caution, admitted serving alcohol after hours and allowing off-licence sales at Shish, and accepted a caution for two offences under section 136 of the Licensing Act 2003. p14

• p14On Tuesday the 21 st of June, PS Elrick and SLO Rolfe interviewed Mr Ergun at Hastings Police Station under caution in respect of breaching his licensing conditions at Grand Pera and Shish. Mr Ergan was legally represented, and his rights according to Law were followed. As the legal entity under the Licensing Act 2003 (The Designated Premises Supervisor ) he is responsible for the legal integrity for both premises. In interview it was established that Mr Ergun was both the Premise License Holder and the Designated Premises Supervisor for Grand Pera and Shish. He was able to confirm the conditions and agreed that alcohol was served after hours at Shish. He also admitted by doing so, allowed off license sales. He agrees re Grand Pera that alcohol was also served off premises, and that there was no record of training; failed to maintain incident and refusal books, or negate the effects of tobacco smoke. Mr Ergun took full responsibility and therefore was offered, and accepted, a caution for two offences under S136 of the Licensing Act 2003 - Carry on unauthorised licensable activity.
• p17At 2325hrs on 24/07/2026 Sussex Police Licensing Officer, PC Daren Spalding CS582 observed that Shish Turkish Kebab was open. PC Spalding observed the premises for approximately 15 minutes during which no customers entered. There were four members of staff on duty wearing their blue uniform. The Doner kebab grill was on and the meat was rotating. All the lights were on and the door was wide open. Pc Spalding took a photograph of the premises while open at 2327hrs. Exhibit DJS/01 Pc Spalding took a video of the premises at 2328hrs. Exhibit DJS/02. He recorded a further video at 2329hrs which clearly shows the Kebab grill operating. DJS/03
• p18A few minutes later, PC Spalding spoke with PS Darren FOX, who informed him that members of his Op Marble team had just attended the premises and were told by staff that they would be open until 3am. At this time the premises’ Late Night Refreshment License was suspended due to non-payment of fees. Therefore they were operating illegally oustide of permitted hours by remaining open after 2300hrs. Mr Ergun was fully aware of this.
• p19There were no SIA doorstaff on duty whilst the premises was under observation. Following a hearing on 27 th April 2026 a number of conditions were added to the license. These included the following with regards to SIA
• p20Annex 3. 2. SIA a. Two SIA-licensed door supervisors shall be on duty at the premises from 22:30hrs until closing on Thursdays, Fridays and Saturdays.
