Developer contributions (section 106)

When a development needs something the town has to provide, such as affordable homes, a better play area or a bus shelter, the developer can agree to pay towards it in a legal agreement under section 106 of the Town and Country Planning Act 1990. Each December Hastings Borough Council publishes what was agreed, received, spent and held in the year to 31 March.

Hastings doesn't charge the Community Infrastructure Levy (CIL), the other way councils collect money from development. The council's 2024-25 statement ↗ says (paragraph 1.2): “Hastings Borough Council (HBC) as a Local Authority does not currently operate CIL and enters into Section 106 (S106) legal agreements for planning obligations with developers to collect funding for infrastructure requirements arising from development across Hastings and St Leonards when appropriate.”

“Held at 31 March” is money received in any year and not yet spent: some allocated to a purpose, some kept for maintenance, a little not yet allocated. These are the borough council's figures only: money due to East Sussex County Council (for roads and schools, say) and to Sussex Police is in their own statements. The council says the next statement, for 2025-26, is due to be published in December 2026.

What the money was for, year by year

Newest first. Each amount is as the statement prints it, with the planning application the agreement belongs to; the council's planning search finds each agreement by that reference.

Corrected by Addendum to the report covering 1 April 2021 to 31 March 2022 ↗: money spent from £211,424.80 to £182,900.80, money allocated but not spent from £262,799.78 to £291,323.78, money held at 31 March from £565,473.26 to £593,997.26. The council says it was needed "to address an accountancy error that recorded an amount spent in 2020-2021 as spent again in 2021-2022." The corrected figures are used here.

The year adds up: £776,898.06 held at the start, plus £0.00 received, less £182,900.80 spent, is £593,997.26, the money held at 31 March.

2020-21 (April 2020 to March 2021)

From the council's Infrastructure Funding Statement for 2020-21 ↗.

Spent: not shown

The statement's figures don't agree; see the note at the end of the year. Its list of spending:

Allocated to a purpose but not yet spent, at 31 March: £432,665.52

Received but not yet allocated, at 31 March: £98.09

Kept for long-term maintenance, at 31 March: £344,134.45

Sums paid so the council can look after play areas, open spaces and nature reserves over the years; the statement lists each one.

Agreed in agreements signed in the year: £60,000.00

Received in the year: £50,000.00

Corrected by Addendum to the first 2 reports covering 1 April 2019 to 31 March 2021 ↗: money allocated but not spent from £356,675.52 to £432,665.52, money held at 31 March from £700,908.06 to £776,898.06. The council says it was needed "to address a historic accountancy error due to changes in our accounting system and historic data not being moved across accurately." The corrected figures are used here.

* The statement's table of spending lists amounts that add up to £70,711.68, but its own total and its summary say £70,691.68, a difference of £20.00. Because they don't agree, this page gives no figure for it; both are quoted here as the council printed them.

* The statement's table of money not yet paid lists amounts that add up to £433,050.00 (the table itself prints £433,050.00), but its summary says £434,722.76, a difference of £1,672.76. Because they don't agree, this page gives no figure for it; both are quoted here as the council printed them.

The table of money kept for maintenance prints its total as £344,144.45; its rows and the statement's summary both come to £344,134.45, which is used here.

The year doesn't add up from the statement's own totals: £797,609.74 held at the start, plus £50,000.00 received, less £70,691.68 spent, is £776,918.06, but the statement says £776,898.06 was held, £20.00 less. With the spending table's own list (£70,711.68) in place of its total, it does.

How this page is made

Read from the council's statements (all on its Infrastructure Funding Statement page ↗, read on 12 October 2026) with fixed rules; no language model is involved. Each statement's summary gives the year's figures. A figure is shown only when it reconciles to the penny: the money held must equal the money allocated, not yet allocated and kept for maintenance, and each list of payments must add up to the summary's figure. Where the council corrected a statement later, the corrected figure is used and the original is given.
