Reason: This condition is imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act 1990.

  2. Built to the approved plans
    The development hereby permitted shall be carried out in accordance with the following approved plans: 2403 10C, 2403 11B, 2403 12B, 2403 13B, 2403 15C, 2403 16B, 2403 17A, 2403 18C, 25037 [name removed] 1220 S4 P01

Reason: For the avoidance of doubt and in the interests of proper planning.

  3. Construction management
Prior to the commencement of development, a detailed land stability scheme (supplementary to the Supplementary Report, Phase 2 Site Investigation and Revised Construction Method Statement (Ref H3929, Issue 1, June 2026)) shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be prepared by a suitably qualified and competent person and shall include: a) ground conditions data and geotechnical parameters, based on the results of a further appropriate intrusive ground investigation (boreholes should penetrate beyond the intended depth of any piles in accordance with current guidance, including insitu and laboratory geotechnical testing); b) detailed design calculations and drawings for the proposed foundations, retaining structures and associated stabilisation works, informed by the findings of the ground investigation; c) an assessment of slope stability during both the temporary construction phase and permanent condition, including consideration of the instability of adjoining land and structures, plant and material surcharges during construction, and changes in topography arising from the development; d) a final detailed construction method statement setting out the proposed sequence and methodology for excavation, piling and construction of retaining structures, including details of temporary works and propping, and details of measures for the management and control of groundwater and surface water during excavation and construction. The development shall thereafter be carried out in accordance with the approved details.

Reason: To ensure that the development would not adversely affect the stability of the site or surrounding land, in accordance with Policy DM5 of the Hastings Local Plan - Development Management Plan (2015) and Policy P2 of the National Planning Policy Framework.

  4. Drainage and flooding
Prior to the commencement of development the proposed means of foul sewerage and surface water disposal must be submitted to and approved in writing by the Local Planning Authority in consultation with Southern Water. The works shall then be completed in accordance with the approved details.

Reason: To prevent increased risk of flooding.

  5. Drainage and flooding
Prior to the commencement of development, the following details of proposed surface water drainage system should be submitted to and approved in writing by the Local Planning Authority: i. Detailed drainage layout with supporting hydraulic calculations should be submitted. The drainage layout should show the piped layout and outfall with connections and invert levels. The hydraulic calculations should take into account the connectivity of the different surface water drainage features. ii. The Environment Agency's risk of surface water flooding maps shows an existing overland surface water flow route through the site from the east. Blocking the existing flow route may lead to increase surface water flood risk to the properties located east and south of the development site. The applicant should therefore provide information on how the proposed site layout affects the existing overland surface water flow route and the measures which will be taken to ensure that there is no increase to flood risk of neighbouring properties from this flow route. iii. information on how surface water flows exceeding the capacity of the surface water drainage features will be managed safely. The proposed surface water drainage system shall then be installed in accordance with the approved details and maintained and retained for the lifetime of the development.

Reason: To prevent increased risk of flooding.

  6. Trees and landscaping
Prior to the commencement of development, the developer must submit the landscaping proposals for approval in writing by the Local Planning Authority (in consultation with Southern Water). The landscaping shall then be planted in accordance with the approved details and maintained in accordance with the approved details for the lifetime of the development unless otherwise agreed in writing by the Local Planning Authority.

Reason: To protect public sewer apparatus and to ensure there is no increased risk of flooding.

  7. Trees and landscaping
No development shall take place until there has been submitted to and approved by the Local Planning Authority a scheme of soft landscaping, which shall include indications of all existing trees and hedgerows on the land including details of those to be retained, together with measures for their protection in the course of development. New soft landscaping details shall include planting plans; written specifications (including cultivation and other operations associated with plant and grass establishment); schedules of plants, noting species, plant sizes and proposed numbers/densities where appropriate together with an implementation programme. The scheme of soft landscaping shall be implemented in accordance with the approved details prior to the occupation of the development.

Reason: To ensure a satisfactory form of development in the interests of the visual amenity.

  8. Biodiversity and ecology

Thereafter the construction of the development shall then be carried out in accordance with BS5228 Noise Vibration and Control on Construction and Open Sites and The Control of Dust And Emissions From Construction And Demolition Best Practice Guidance unless previously agreed in writing by the Local Planning Authority. The approved Plan shall be adhered to throughout the construction period. The CEMP (Development) shall include the following: · Indicative programme for carrying out the works · Measures to minimise the production of dust on the site(s) · Measures to minimise the noise (including vibration) generated by the construction process to include the careful selection of plant and machinery and use of noise mitigation barrier(s) · Maximum noise levels expected 1 metre from the affected facade of any residential unit adjacent to the site(s) · Design and provision of site hoardings · Management of traffic visiting the site(s) including temporary parking or holding areas · Details of the arrangements for site-operative parking · Measures to prevent the transfer of mud and extraneous material onto the public highway · Measures to manage the production of waste and to maximise the re-use of materials · Measures to minimise the potential for pollution of groundwater and surface water · The location and design of site office(s) and storage compounds · The location of temporary vehicle access points to the site(s) during the construction works · The arrangements for public consultation and liaison during the construction works

Conservation and heritage on this street

Measured along the street’s line against the council’s boundaries. Whether a particular building is inside depends on where the boundary runs: each area’s page on the council’s site has its map. All 18 conservation areas

The council’s street index lists these properties on Milward Road under Article 4 directions, which take away some building work that wouldn’t otherwise need planning permission:

The council’s Article 4 direction on houses in multiple occupation covers the whole town (in force since 2 July 2012): turning a house into a shared house for three to six people needs planning permission. The council’s page ↗

Indicative only — the council’s order is what counts. The council says of its tree order map data: “This dataset is under review and subject to change. Always refer to the Original Tree Preservation Order and associated plan for confirmation.” The council’s tree preservation orders page ↗

Flood zones, the coast and protected nature on this street

We place an application by the street in its address, so these say where Milward Road runs, not where the site’s boundary is. The application’s own documents on the council’s file show the site.

Flood zones

None of Milward Road’s line is in Flood Zone 2 or 3 on the Environment Agency’s flood map for planning. In the Agency’s words: “This means a site in flood zone 1 could still flood now or in the future.”

A street’s line is not an address. For a particular address, use the Environment Agency’s Check your long term flood risk ↗; for a planning site, its Flood map for planning ↗. Flood warnings in force now are on Live now.

Protected nature

No Site of Special Scientific Interest, Special Area of Conservation, Local Nature Reserve, ancient woodland or country park is within about 100 m of Milward Road’s line, and it is outside the High Weald National Landscape. Protected nature in Hastings
