What it recommends
- “REFUSE”
In plain English
Recommended · This went to the meeting on Wed 21 Oct 2026. What was decided is in that meeting's minutes.
The report's recommended reasons for refusal include that the scale and massing would amount to overdevelopment and poor design, that the development's scale, design and proximity to boundaries would harm neighbouring residents' privacy through overlooking and perceived overlooking, and that it fails to provide adequate green infrastructure. p187p188p189
Further recommended reasons include that the layout would not be accessible to all because of substandard path widths, that it does not provide adequate means for removing waste and recycling, and that insufficient information was submitted on noise mitigation, ground stability and the development's sustainability and zero carbon credentials. p190p191p192p193p194p195

- p1871. The proposed development by virtue of the scale and massing is considered to result in overdevelopment of the site and would represent a poor design that fails to take the opportunities available for improving the character and quality of an area and the way it functions. The proposed development is therefore considered contrary to Policy DP3 of the National Planning Policy Framework 2026 together with, Policy DM1 of the Development Management Plan 2015 and Policy SC1 of the Hastings Planning Strategy 2014.
- p1882. The development by virtue of the scale, design and proximity to the site boundaries is considered to have a detrimental impact on the residential amenities of the neighbouring properties in terms of loss of privacy, overlooking and perceived overlooking. The development therefore fails to comply with Policy DM3 of the Hastings Development Management Plan and Policy P3 of the National Planning Policy Framework 2026.
- p1893. The development by virtue of the design fails to provide good quality, robust green infrastructure. The proposal therefore fails to comply with Policy HN7 of the Hastings Development Management Plan and Policy DP3(2c) of the National Planning Policy Framework 2026.
- p1904. The development by virtue of the design and proposed layout, by reason of substandard path widths, would not be accessible to all, being below minimum widths set out in Inclusive Mobility Documents produced by the Department of Transport (2021). As such the proposed development would be contrary to policy DM4 (f) of the Hastings Development Management Local Plan 2015.
- p1915. The development by virtue of the site layout fails to provide adequate and practical means for the removal of waste and recycling from the site. The proposal therefore fails to comply with the requirements of Policy DM3 of the Hastings Development Management Plan.
- p1926. Insufficient information has been submitted in respect of noise mitigation measures. As a result of this formal assessment of these matters has not been possible. The proposal therefore fails to satisfy the criteria of Policy DM6 of the Hastings Development Management Plan 2015 and Policy P3 of the National Planning Policy Framework 2026.
- p1937. Insufficient information has been submitted in respect of the level of excavation require to facilitate the development, potential stability issues, retaining structures or how any potential impact on the existing boundary wall can be mitigated. As a result of this formal assessment of these matters has not been possible. The proposal therefore fails to satisfy the criteria of Policy P2 of the National Planning Policy Framework 2026 along with Policy DM5 of the Hastings Development Management Plan 2015.
- p1948. Insufficient information has been submitted to demonstrate how the development has complied with the energy hierarchy in terms of working
- p195towards zero carbon development, by focusing on energy efficiency first, followed by the provision of on-site renewable energy generation and other off site large scale solutions as necessary. The proposal therefore fails to meet the aims of Policies CC2, CC3 and DP3 of the National Planning Policy Framework 2026 along with SC3 and SC4 of the Hastings Planning Strategy.
